Unlike the earlier stages of the process where decisions are made on paper, the ALJ hearing allows you to appear in person, present testimony, and address the judge’s concerns directly. Here’s how to prepare.

1. Review Your Entire File

Before your hearing, request a copy of your complete claim file from the SSA. This file contains all the evidence the ALJ will review, including your medical records, work history, prior decisions, and any other documents in your case. Review everything carefully to:

Identify any missing or incomplete medical records

Spot any errors in your work history or earnings record

Understand what issues the ALJ is likely to focus on based on prior denial reasons

2. Submit Updated Medical Evidence

Any medical records that have been generated since your initial application should be submitted to the SSA at least 5 business days before your hearing. Updated records showing ongoing treatment and worsening or persistent symptoms are critical. Ask your treating physicians to prepare updated treatment summaries and RFC opinions if possible.

3. Obtain a Medical Source Statement (RFC Opinion)

One of the most valuable pieces of evidence at an ALJ hearing is a detailed RFC opinion from your treating physician. This document should describe specifically what you can and cannot do in a work setting:

How long you can sit, stand, and walk in an 8-hour workday

How much weight you can lift and carry

How often you would need to take unscheduled breaks or lie down

How many days per month you would likely miss work

What percentage of a workday you would be off-task due to symptoms

Any specific environmental restrictions (no fumes, no temperature extremes, etc.)

4. Prepare Your Personal Testimony

You will be asked to testify about your daily life and limitations. Prepare honest, specific answers to common questions:

What are your current medical conditions and how do they affect you day-to-day?

What is a typical day like for you?

What activities can you no longer do that you used to do?

How long can you sit, stand, or walk before pain or fatigue forces you to stop?

How often do you have bad days, and what are they like?

What medications are you taking, and do they cause side effects?

Always describe your worst days, not your best. The ALJ needs to understand your functional limitations at their most severe.

5. Prepare for Vocational Expert Testimony

Ask your representative to explain the types of hypothetical questions the VE is likely to be asked, and to prepare cross-examination strategies for challenging the VE’s testimony if necessary.

6. Dress and Conduct Yourself Appropriately

Dress neatly but appropriately for your condition. Do not wear clothing that minimizes your limitations — if you normally use a cane or brace, bring and use it. Be respectful and honest throughout the hearing. Never exaggerate, but don’t minimize your symptoms either.

7. Work with an Experienced Representative

Having a knowledgeable disability representative at your side is one of the most significant factors in ALJ hearing outcomes. Representatives understand hearing procedures, know how to challenge unfavorable VE testimony, and can ensure your full story is presented to the judge.

Preparation is the key to hearing success.
